1. Overview

These Terms of Service ("Terms") govern your use of EstatePlan Ready ("we," "us," or "our"), a web application that helps individuals organize their assets, contacts, and wishes into a comprehensive estate plan summary for attorney review. The service is operated by EstatePlan Ready.

By creating an account or using EstatePlan Ready in any way, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the service.

These Terms apply to all users of the service, including individual subscribers and invited guest viewers. If you have been invited to view someone else's estate plan, your use of the service is also governed by these Terms.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to create an account and use EstatePlan Ready. By using the service, you represent and warrant that you meet these requirements.

EstatePlan Ready is not directed at children under 18, and we do not knowingly allow minors to create accounts. If you believe a minor has created an account, please contact us so we can remove it.

3. Accounts & Account Types

To use EstatePlan Ready, you must create an account by providing a valid email address and password, or by signing in with Google. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

The service supports two account types:

3.1 Individual Subscriber

A paying subscriber who can create and manage their own estate plan, use all features of the service, and invite others to view or edit their plan. Requires an active subscription.

3.2 Invited Guest

A user who has been invited by a subscriber to view (or edit) that subscriber's estate plan. Guest accounts do not require a subscription and have access only to the plans shared with them. Guests cannot create their own estate plans or invite others unless they purchase their own subscription.

You agree to provide accurate and complete information when creating your account and to update it as necessary to keep it current.

4. Subscriptions & Billing

EstatePlan Ready is a subscription service. The following plans are available:

4.1 Plans

  • Monthly: $5.00 per month, billed monthly.
  • Annual: $60.00 per year, billed annually.
  • Payment: Subscriptions are billed through Base44 Payments (powered by Wix). By subscribing, you authorize us to charge the selected payment method on a recurring basis until you cancel.
  • Automatic renewal: Your subscription renews automatically at the end of each billing cycle (monthly or annually) until you cancel it. You will be charged the then-current rate.
  • Cancellation: You may cancel your subscription at any time from your account settings. Cancellation stops future charges but does not refund the current billing period. You retain read-only access to your data until the end of your current billing period, after which all your data is permanently deleted.
  • Price changes: We may change our subscription fees upon reasonable notice. Any price change takes effect at the start of your next billing cycle following the notice.
  • Refunds: All fees are non-refundable except where required by applicable law. If you believe you have been charged in error, please contact us promptly.

5. The Service

EstatePlan Ready provides the following features to individual subscribers:

  • A guided estate planning wizard covering personal information, fiduciary appointments, assets, liabilities, documents, wishes, and contacts.
  • Summary pages for net worth, assets, liabilities, beneficiaries, wishes, and contacts.
  • Export of your estate plan summary as a printable PDF for attorney review.
  • An appointment calendar for tracking consultations, renewals, and follow-ups.
  • Plan sharing with up to three invited people, with read-only or read-write permission.

We may add, modify, or discontinue features at any time. We will provide reasonable notice of material changes to the service. We do not guarantee that the service will be uninterrupted, error-free, or available at all times.

6. Plan Sharing & Invitations

Subscribers may invite up to three people to view or edit their estate plan. When you invite someone, an email notification is sent on your behalf inviting them to access your plan.

  • Permission levels: You may grant read-only or read-write access to each invitee. You can revoke access at any time.
  • Guest accounts: Invitees who do not yet have an EstatePlan Ready account will be invited to create one. Once they sign in, they become guest users with access only to the plans shared with them.
  • Inviter responsibility: You are responsible for ensuring you have the right to share your estate plan data with the people you invite. We are not liable for disputes between you and your invitees.
  • Invitation limits: To prevent abuse, invitations are rate-limited. New accounts must be at least 24 hours old before sending invitations. A maximum of three invitations may be sent per inviter (lifetime), and app-wide limits apply.
  • No spam: You may not use the invitation feature to send unsolicited emails to people who have not agreed to be invited. Misuse of the invitation system may result in suspension of your account.

7. Security & MFA

We take reasonable measures to protect your data, including encryption in transit and at rest, row-level security isolating your data from other users, and server-side service roles for sensitive operations.

  • Multi-Factor Authentication (MFA): We offer time-based one-time password (TOTP) MFA. MFA is required for certain sensitive operations, including viewing shared plans and deleting your account. We strongly encourage enabling MFA for all users.
  • Recovery codes: When you enable MFA, recovery codes are provided. You are responsible for storing them securely. If you lose access to both your MFA device and recovery codes, you may lose access to your account.
  • Account security: You are responsible for keeping your account secure. Notify us immediately if you suspect unauthorized access to your account.
  • No guarantee: Despite our efforts, no system is perfectly secure. We do not guarantee absolute security of your data.

8. Not Legal Advice

EstatePlan Ready is an organizational and informational tool. It is not a law firm and does not provide legal advice, legal services, or attorney representation. The estate plan summary generated by the service is intended to help you organize your information for review by a qualified attorney.

Nothing in the service constitutes legal, tax, financial, or estate planning advice. You should consult with a licensed attorney and other qualified professionals before making decisions about your estate plan. The service does not create an attorney-client relationship between you and EstatePlan Ready.

The service does not store your actual legal documents (wills, trusts, powers of attorney). It records where such documents are located and their status, but the documents themselves remain your responsibility to create, store, and maintain with a qualified attorney.

9. Acceptable Use

You agree not to use EstatePlan Ready to:

  • Violate any applicable law, regulation, or third-party right.
  • Send unsolicited or spam emails through the invitation feature.
  • Attempt to gain unauthorized access to other users' data, the service's systems, or any third-party systems.
  • Interfere with or disrupt the service, including attempting to overload, crash, or reverse-engineer the application.
  • Use the service for any fraudulent, abusive, or unlawful purpose.
  • Share your account credentials with others or allow multiple people to use a single subscription.
  • Scrape, copy, or extract data from the service in an automated manner.
  • Upload or store malicious code, viruses, or harmful content.

Violation of these rules may result in suspension or termination of your account without notice.

10. Intellectual Property

EstatePlan Ready, including its software, design, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the service without our written permission.

You retain all rights to the estate plan data you enter into the service. You grant us a limited license to host, process, and display your data solely as necessary to provide the service to you and to the people you have authorized to access your plan.

The printable PDF generated from your estate plan is your property. You may share it with your attorney and other advisors as you see fit.

11. Third-Party Services

The service integrates with third-party services, including:

  • Base44 Payments (powered by Wix): for subscription billing and payment processing.
  • Google OAuth: for optional sign-in with your Google account.
  • Google Maps / Places API: for address autocomplete when entering property addresses.
  • RentCast API: for approximate property value lookups.

We are not responsible for the practices of these third-party services. Your use of third-party services is subject to their respective terms and policies. We may modify or replace third-party services at any time without notice.

12. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • We do not warrant that the service will be uninterrupted, secure, or error-free.
  • We do not warrant that the estate plan summary generated by the service is accurate, complete, or legally sufficient.
  • Property value estimates provided through the RentCast integration are approximations and should not be relied upon as appraisals or official valuations.
  • You are solely responsible for the accuracy of the information you enter and for verifying any data the service presents.

13. Limitation of Liability

To the fullest extent permitted by law, in no event shall EstatePlan Ready, its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the service.

Our total aggregate liability for any claim arising from or related to the service shall not exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless EstatePlan Ready, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms, your violation of any third-party right, or your misuse of the invitation or sharing features.

15. Suspension & Termination

You may delete your account at any time from your security settings. Upon deletion, all your data is permanently removed and your subscription is cancelled.

We may suspend or terminate your account and access to the service at any time, with or without notice, if we believe you have violated these Terms, if your account poses a security risk, or if required by law. Upon termination, all licenses granted to you under these Terms cease immediately.

Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) shall remain in effect after your account is terminated.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. We will post the updated Terms on this page and update the "Last updated" date above. Material changes will be communicated through the service or by email. Your continued use of the service after any changes take effect constitutes your acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. You and EstatePlan Ready agree to submit to the personal jurisdiction of the courts located in the applicable jurisdiction for any disputes arising out of or related to these Terms or the service.

If you are a consumer in the European Union or United Kingdom, you may also rely on the mandatory consumer protection laws of your country of residence, and nothing in these Terms limits any statutory rights you may have that cannot be waived by contract.
